General terms and conditions

These general terms and conditions are put forward by the FreshwaterLife project partners and owners. The direct assignable body is the Freshwater Biological Association (FBA), The Ferry Landing, Far Sawrey, Ambleside, Cumbria, LA22 OLP, United Kingdom. This assemblage of project partners will from herein be referred to as FreshwateLife.

FreshwaterLife assembles, constructs and administers several databases, systems, software packages and websites with the aim of providing a freshwater information service. These systems, and the data and other content held by these systems, will be referred to collectively as the FreshwaterLife website. This should be taken to include all FreshwaterLife products, including CD-ROMs, documents and other publications derived from these systems and their content.

Use of our site

By using this site you are agreeing to be bound by these general terms and conditions. You also agree to be bound by the FreshwaterLife Copyright Statement, which forms part of these general terms and conditions. If you access and use any of the data made available to you on this site, you do so subject to this agreement. Additionally, some of the data you access may be subject to specific terms that the owner or supplier of that data has imposed upon its use. (We call these Specific Terms of Access.)

If there is any conflict or inconsistency between these General Conditions, the FreshwaterLife Copyright Statement or the FreshwaterLife content and submission policy and the Specific Terms of Access, the Specific Terms of Access will prevail, but only in relation to the particular data restricted by those Specific Terms of Access, and only to the extent necessary to resolve that conflict or inconsistency.

No delay, neglect or forbearance on the part of FreshwaterLife in enforcing any of these General Terms and Conditions, Copyright or Submission policies will be, or be deemed to be, a waiver. Nor will it prejudice any right of FreshwaterLife. If any of these General Terms and Conditions is for any reason held to be unenforceable, illegal or in some other way invalid, the unenforceable, illegal or invalid provision will not affect the remainder of these General Conditions, and they will continue in full force and effect. These General Terms and Conditions are governed by English law and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales. The place of performance will be England. No addition to or modification of any provision of these General Conditions will be binding on FreshwaterLife unless made in writing and signed by their duly authorised representatives. "Writing" includes e-mail communications.
